I'm assuming you are speaking of overtaking.

This varies from Dept to Dept, as I'm sure you are aware. Some Depts require their Officers to have all their emergency equipment on while overtaking. The thinking behind this is, the Officer must break the speed limit to overtake the vehicle, so they must utilize the equipment.

On the flip side, some Depts believe that if you can covertly (no lights and siren) overtake the suspect vehicle you can gain more evidence to use against them, pace their speed, look for cues of imparement, etc.

There are benefits to both sides of the argument. It is common practice here to have your rear lights activated so when you pass a citizen, they know, or hopefully know, that there is a reason you just blew by them.

Many times having all your equipemnt activated can just confuse the other motorists and you have a harder time navigating traffic, than with no front lights at all.

We treat it as though you are, or should be code three. It is at the officers dicretion/peril to operate without lights and siren in order to "catch up" to an offender. So...in answer to your question, the pursuit policy applies.

Oklahoma law requires that if you break the law, you must have all emergency equipment on. I have had a lot of requests on the catch up driving language in policy. I imagine there are numerous agencies that use it. I'll ask our policy folks if they know of any.
